1. Legal notice

1.1 By accessing the websites at https://alcohol.ninja and https://ninjadelivery.co.uk, including any other integrated resourses and related applications you are agreeing to be bound by these website terms, all applicable laws and regulations and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms and conditions, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

1.2 We reserve the right to change these website terms from time to time by changing them on this page. We advise you to print a copy of these website terms for future reference. These website terms are only in the English language.

1.3 Use of your personal information submitted via the website is governed by our Privacy Notice and Cookies Policy.

1.4 In this document, "we", "our", or "us" refer to Ninja Delivery Limited.

1.5 Please note that references to "website" in these website terms include any current or future version of our websites at https://alcohol.ninja and https://ninjadelivery.co.uk as well as any other integrated resourses and related application through which you access and use our website, in each case whether accessed through any current or future platform or device, including without limitation any mobile website, mobile application, affiliate website or related website for accessing and using our website that may be developed from time to time.

1.6 By accessing any part of this website, you indicate that you accept these website terms. If you do not accept these website terms, you should leave the website immediately, and you will not be able to order any products through the website.

2. Placing an order

2.1 By placing an order with us, you warrant that:

2.3 If you have a specific food allergy or intolerance, you must contact us directly to check that the food is suitable for you.

2.4 If you are ordering alcohol or tobacco products you must be at least 18 years old. We only sell alcohol to over 18’s, identification will be required if you are lucky enough to look under 25 as we operate a very strict  ‘challenge 25’ policy.

2.5 If you are unable to provide proof that you are aged 18 or if the delivery driver reasonably believes that the alcohol, cigarettes or other smoking products you have ordered have been bought by you on behalf of someone under the age of 18, we reserve the right not to complete the delivery of the alcohol, cigarettes or other smoking products to you. Additional charges may apply. If you are under 18 or buying alcohol and tobacco products for someone under the age of 18, you are committing a criminal offence.

2.6 We reserve the right to amend and or withdraw any or all of our offers, discounts & promotions, therefore they are subject to change at our discretion and with no prior warning.

2.7 We will only accept GBP sterling, we reserve the right to not accept any other currency at our discretion and at any time.

3. Using product and information provided

4. Delivery

4.1 Our around the clock 1 (one) hour delivery service available only for the post codes listed in our Postcode Checker.

4.2 Although we take pride in our quick delivery times and strive to meet quoted times of delivery, please note that your ETA (estimated delivery time) may be subject to change at any given time peak or non peak. This would normally be down to unforeseen circumstances that we have no control over and or alteration of a customer's order. Your ‘ETA’ or the estimated time of arrival of your order is just an estimate and can change at peak times and during busy periods.

4.3 Staff have the right to refuse orders to abusive, under-age or overly intoxicated customers.

4.4 If your postcode is not listed in our Postcode Checker - only scheduled deliveries or orders by special arrangements can be made.

4.5 When you place an order, you will have the choice to place it as an ASAP Delivery or a scheduled delivery. For an ASAP delivery, we will attempt delivery as soon as possible; you must therefore be available to accept delivery from the time you place the order. For a scheduled delivery, we will deliver the order at the specified by you time and on the specified by you date, that you have left in the order notes section; you must be available to accept delivery for ten minutes before and ten minutes after that time.

4.6 Unfortunately, despite our, and our partner's best efforts, things do not always go to plan and factors such as traffic and weather conditions may prevent us from delivering your item on time. If your order is more than 15 minutes late, and we haven’t notified you giving you the option to cancel your order, we will work with you to make things right unless you have caused the delay (e.g. because you gave us the wrong address or did not come to the door).

4.7 We will attempt delivery at the address you provide to us when you place your order. If you need to change the delivery location after you have placed your order, we may be able to change to the address to an alternative one that is registered with your account if you let us know before the driver has been dispatched, and the new address is within the same zone as the address you originally ordered your Item to. If we cannot change the delivery address, you have the option to cancel the order, but if food preparation has started you will be charged the full price for the Item, and if the driver has been despatched you will also be charged for delivery.

4.8 You will still be charged for the Item and for delivery in the event of a failed delivery if you have caused such failure for any reason. Reasons you might cause a delivery to fail include, but are not limited to:

4.9 You do not come to the door, did not pick up the phone when the driver contacted you using the contact information you have provided us and/or you picked up the phone but then failed to provide access within a reasonable amount of time, and the driver is unable to find a safe location to leave the item.

4.10 The driver refuses to deliver the item to you in accordance with Section 5 (Alcohol and Tobacco - Age Related Sales).

4.11 Please note, our vehicles and delivery operatives may be equipped with video and audio recording devices for crime prevention, improving community safety and training purposes to improve customer service. Thank you for your acceptance and understanding in advance. Please contact our office directly in case of any queries in these regards before you start using this service.

5. Your rights if something is wrong with your items

5.1 You have a legal right to receive goods which comply with their description, which are of satisfactory quality and which comply with any specific requirements you tell us about (and we agree to) before you place your order. If you believe that the Items you have been delivered do not comply with these legal rights, please let us know. We may request a photograph showing the problem if it is something that can be seen by inspecting the Items. We will provide a refund or account credit in respect of the affected part of the Item, and also in respect of delivery if the whole order was affected, unless we have reasonable cause to believe that the problem was caused after delivery.

5.2 Prior to processing your refund or account credit, we may take into account relevant factors including the details of the order, including your account history, what happened on delivery and information from the partner shop/restaurant and supplier.

6. Payments

6.1 All sales of alcohol and tobacco for delivery must be paid at the time of ordering using a debit or credit card on your name only. You will be asked to provide this card for verification purposes upon delivery.

6.2 Payment must be made by debit or credit cards. You cannot pay for your order by cheque. There is no minimum order requirement however for orders below £34.99 (GBP), delivery charge of £9.99 (GBP) will apply; there is no delivery charge for orders over £34.99 (GBP).

6.3 Any unpaid orders will be subject to a £90.00 (GBP) administration charge at the expiry of 48 hours of your order being placed. Unless a full payment has been received within the further 7 (seven) calendar days the debt will be passed on to a debt recovery agency.

7. Delivery address

7.1 The delivery of alcohol and tobacco products will be made only to address where the customer is clearly resident inside the building.

7.2 The delivery of alcohol and tobacco products will not be made or completed to a person in a public place (e.g street corner, park or bus stop).

8. Proving your age - no ID no sale

8.1 Acceptable forms of identification are recognised photographic identification cards such as a driving licence, passport, military identification card or a Proof of Age card carrying a ‘PASS’ logo.

8.2 Customers placing orders via the internet or the telephone shall be required to verify their age upon delivery of any alcohol or smoking products. The only forms of acceptable identification are those indicated above.

9. Proxy sales

It is a criminal offense to purchase alcohol on behalf of persons under eighteen years of age. We do not authorise the purchase of alcohol or tobacco products to anyone that is under age.

10. Drunk and disorderly behaviour

10.1 You will be refused the sale if found intoxicated upon delivery.

10.2 Please respect our operatives and the public around you. Offensive behaviour will not be tolerated. The sale will be refused, and offenders prosecuted.

11. Gift Wrapping

11.1 We offer a gift wrap service on most items.

11.2 Gift wrapping includes: gift wrap, box, or bag appropriate for the item with decorative ribbon and printed card with your gift message on the top of the package.

11.3 The option to Gift Wrap will be displayed next to your chosen item, called "Add Gift Wrapping". Prices vary depending on the size and shape of the item you have purchased and usually comes to £9.99 GBP.

11.4 Very few items can't be gift-wrapped because of their size, shape, or because they're too fragile - these items will often be shipped in their original box rather than our box. If this is the case, you'll see a notice during checkout or won't have an option to "Add Gift Wrapping" next to your chosen item.

12. Website access

You may access some areas of this website without making an order or registering your details with us. Most areas of the website are open to everyone. By accessing any part of the website, you indicate that you accept these website terms. If you do not accept these website terms, you should leave this website immediately, and you will not be able to order any products through this website. We may revise these website terms at any time. You should check this page regularly to review the current website terms, because they are binding on you. You will be subject to the policies and terms and conditions in force at the time that you place an order with us. You are responsible for making all arrangements necessary for you to have access to the website. You are also responsible for ensuring that all persons who access the website through your internet connection are aware of these website terms and that they comply with them.

13. User license

13.1 Permission is granted to temporarily download one copy of the materials (information or software) on the website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

15. Limitations

In no event shall we or our partners and suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on our website, even if we or our authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

16. Offers and promotions

16.1 From time to time we run promotions.

16.2 Only one offer or promotion can be used per order. A promotion may not be used in combination with other promotions or used to collect reward points except where specified.

16.3 Promotional items that you purchase (either free of charge or at a proportional rate) do not qualify nor count towards your basket value in order to redeem further free promotional items. We reserve the right to cancel any order(s) which we deem to have attempted to purchase promotional items in order to increase basket size to qualify for further promotions. From time to time certain products may be excluded from current promotions and any such exclusion will be notified to you through a notice on the website.

16.4 Excluded products will not count towards any qualifying conditions for offers and will not benefit from any promotional discount.

16.5 All offers and promotions are subject to availability and while stocks last. We reserve the right to end a promotion at any time.

16.6 We shall not be liable for any financial loss arising out of the refusal, cancellation or withdrawal of any offer and promotion or any failure or inability of a customer to take advantage of a promotion for any reason.

16.7 All offers and promotions are time limited.

16.8 All offers and promotions can only be used once per houshold.

16.8 All offers and promotions are subject to minimal order amout of at least £19.99.

16.9 All offers and promotions are subject to standard delivery fees and policies.

17. Accuracy of materials

The materials appearing on our website could include technical, typographical, or photographic errors. We do not warrant that any of the materials on the website are accurate, complete or current. We may make changes to the materials contained on its website at any time without notice. However we do not make any commitment to update the materials.

We have not reviewed all of the sites linked to our website and can not be responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by us of the site or other web resourse. Use of any such linked website is at the user's own risk.
